Terms of Service

1. Acceptance

By creating an account or using Gift of Gab ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and Region Home Finder Inc. ("we", "us", "Gift of Gab").

2. Eligibility

You must be at least 18 years old and authorized to enter into contracts in your jurisdiction. By using the Service, you represent that you meet these requirements. The Service is intended for professional real estate agents and brokers.

3. Account Registration

You must provide accurate, complete information when registering. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access at hello@giftofgab.ca.

4. Subscriptions and Billing

• The Service is available on a subscription basis. Pricing is listed on our website and may be updated with notice.
• Subscriptions renew automatically unless cancelled before the renewal date.
• We offer a 14-day free trial. No charge is made until the trial ends.
• Refunds are not provided for partial billing periods, except where required by law.
• If payment fails, we will retry up to 5 times. After the grace period, your account may be suspended.

5. Acceptable Use

You agree not to:

• Record calls without the consent of all parties where required by law (you are solely responsible for compliance with call recording laws in your jurisdiction).
• Use the Service to harass, spam, or defraud any person.
• Attempt to reverse-engineer, scrape, or copy any part of the platform.
• Share your account credentials with others.
• Violate any applicable law or regulation.

6. Call Recording Compliance

You are solely responsible for obtaining all necessary consents before recording any call using the Service. Requirements vary by jurisdiction (e.g., one-party vs. all-party consent). Gift of Gab provides the technology; compliance is your responsibility.

7. Intellectual Property

Gift of Gab and its underlying technology, design, and content are owned by Region Home Finder Inc. and protected by intellectual property law. You retain ownership of your data (call recordings, transcripts, contact information). You grant us a limited license to process your data solely to provide the Service.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Third-Party Integrations

The Service integrates with third-party platforms including Follow Up Boss, Twilio, Stripe, and OpenAI. Your use of these integrations is also subject to the respective third-party terms of service. We are not responsible for the availability, security, or conduct of third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE. AI outputs (transcripts, summaries, follow-up suggestions) are provided for informational purposes and should be reviewed before relying on them.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIFT OF GAB'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Termination

Either party may terminate the subscription at any time. We may suspend or terminate your account immediately for material breach of these Terms. Upon termination, your access to the Service ends and we will retain your data for 30 days before deletion, unless a longer retention is required by law.

13. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada. Any dispute arising under these Terms shall be resolved by the courts of Montreal, Quebec.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
